The leaked investment chapter of the Trans-Pacific trade agreement
(TPPA) being negotiated between the US, Australia, New Zealand, Peru, Chile,
Singapore, Brunei, Malaysia and Vietnam is available at http://tinyurl.com/tppinvestment
.
The chapter contains special rights for foreign investors to sue
governments for damages if a law or policy harms their investment, known as
investor-state dispute settlement (ISDS) (section B).
However, the chapter shows that the Australian Government has kept to
its policy of opposing ISDS, and is refusing to apply the right of investors to
sue governments in Australia (footnote to article 12.1). AFTINET supports the
government's policy, and would prefer if the right of foreign investors to sue
was not included in the TPPA at all.
